Extraordinary Immigration Regularisation 2026 – Approved by the Council of Ministers
ATTENTION! EXTRAORDINARY REGULARISATION PROCESS
On 27 January 2026, the Council of Ministers approved the urgent processing of the Royal Decree that will allow the regularisation of approximately 500,000 foreign nationals currently in an irregular situation in Spain.
What Does the Extraordinary Regularisation 2026 Involve?
This is an exceptional and temporary process allowing foreign nationals already residing in Spain without valid documentation to obtain a one-year residence and work permit. Applications may be submitted from 1 April to 30 June 2026.
Eligibility Requirements
- Prior presence: Proof of entry into Spain before 31 December 2025.
- Minimum stay: Continuous residence of at least 5 months, verifiable through documentation (utility bills, employment contracts, medical certificates, school enrolment, etc.).
- Criminal record certificate: Criminal record certificate from the country of origin, duly apostilled or legalised.
- No criminal record in Spain: Applicants must have no criminal convictions in Spanish territory.
Required Documentation
To prove the 5-month period of residence, both public and private documentary evidence will be accepted: employment contracts (including irregular ones), payslips, utility bills (electricity/water/gas), medical certificates, school enrolment records, tax returns, etc.
The “Fast-Track” Work Authorisation
One of the most significant developments is the provisional decision within 15 days. Following online submission of the application, the Administration will issue a provisional authorisation enabling the applicant to reside and work legally with immediate effect while the final decision is pending.
Special Considerations
- Asylum seekers: Individuals who submitted an international protection application before 31 December 2025 may apply under this extraordinary process.
- Expulsion proceedings: Previous sanction or expulsion proceedings will be automatically suspended and archived upon submission of the regularisation application.
- Duration of the permit: The initial permit will be valid for 1 year, renewable in accordance with Article 191 of the Immigration Regulations.
- Access to Social Security: From the moment the provisional authorisation is granted, beneficiaries may contribute to and access social security benefits.
