Frequently Asked Questions – Tax Returns

When should I submit my 2026 Income Tax Return?

The official filing period for the 2026 IRPF Income Tax Return (for the 2025 fiscal year) is from April 8 to June 30, 2026. We recommend scheduling an appointment in advance to ensure personalized advice.

What documentation do I need for my Income Tax Return?

You will need: ID/NIE, employer withholding certificates, bank account details, information about real estate, receipts for deductions (housing, insurance, pension plans), and any other documents supporting your income and deductible expenses.

When are the quarterly VAT returns submitted?

Quarterly VAT returns (Form 303) must be submitted four times a year: April 1-20 for January-March, July 1-20 for April-June, October 1-20 for July-September, and January 1-30 for October-December.

What happens if I do not submit my tax returns on time?

Failure to meet filing deadlines may result in financial penalties, late payment interest, and possible tax audits. It is essential to comply with all tax obligations within the established deadlines.

Can I deduct expenses for my main residence in the Income Tax Return?

Taxpayers who purchased their main residence before January 1, 2013, may apply a deduction for investment in a main residence. For purchases after that date, this deduction is not available at the national level, although some autonomous communities maintain specific tax benefits.

Frequently Asked Questions about Fiscal Law

Good afternoon. Earlier this year, I realized a substantial capital gain from the sale of an investment property, which will be taxed under the savings tax base of my IRPF. On the other hand, I hold shares in listed companies that are currently trading at a steep loss, as well as an underperforming mutual fund. Can I sell those shares or redeem the fund units before December 31st to offset the capital gain from the property? Are there any specific statutory restrictions or holding periods I must comply with so that the Tax Agency does not disallow the loss?

Yes. Under Spanish Personal Income Tax regulations, you are legally entitled to integrate and offset capital gains and losses realized within the same fiscal period under the savings tax base (base imponible del ahorro). Both the gain generated from the real estate conveyance and the loss arising from the stock sale or mutual fund redemption belong to the same statutory basket.
Consequently, if you formally execute the sale of the shares or the redemption of the mutual fund units before December 31st, the resulting net capital losses will directly offset the capital gain realized from the real estate sale, lowering your taxable savings base subject to progressive tax rates (19% to 28%).
However, you must strictly comply with the anti-wash sale rule:
• For listed securities, the capital loss cannot be computed in the tax period if you acquire homogeneous securities within the two months prior to or following the transfer that triggered the loss.
• For unlisted shares or corporate interests, the repurchase window expands to one year.
• For mutual funds, the loss is deferred if you subscribe to homogeneous units within that same timeframe.
The disallowed loss is not forfeited; its tax recognition is deferred until the subsequent, definitive transfer of the newly acquired replacement assets.

It is essential to highlight critical operational rules reinforced by binding rulings from the Directorate-General for Taxation (Dirección General de Tributos):
1. Hierarchy of Offsetting Rules in the Savings Base: The IRPF Act, capital losses must first be set off exclusively against capital gains realized in the same fiscal year until fully absorbed. If a net negative balance remains, it can be offset against the positive balance of income from movable capital (rendimientos del capital mobiliario, such as dividends or interest income) earned in the same tax year, capped at 25% of that positive balance.
2. Residual Losses and 4-Year Carryforward: If an unabsorbed capital loss persists after applying this mechanism, the remaining balance may be carried forward and offset during the subsequent four calendar years, following the identical statutory order and limits.
3. Execution vs. Settlement Dates: In year-end financial market transactions, account for trade settlement cycles (standard T+2 for equities). The trade execution order must be submitted with sufficient lead time to ensure definitive market settlement and accounting accrual prior to December 31st.

Buenas tardes.

I am an expat living in Almeria. Do I have to pay IRPF on my worldwide income or just what I earn in Spain?

If you spend more than 183 days a year in Spain, you are considered a tax resident and must declare your worldwide income. However, Double Taxation Treaties exist to prevent you from paying twice for the same income.

¿Estoy obligado a declarar si he vendido criptomonedas pero he tenido pérdidas?

¡No necesariamente!

Legal Tips

Buying Property in Almería

Before buying property in Spain, obtain advice not only on the acquisition itself but also on the future tax, wealth planning and succession implications of ownership.

Improve cash flow, reduce bad debts and strengthen financial stability

Before closing the financial year, review all overdue invoices, document collection efforts and assess whether immediate out-of-court or legal action should be taken to protect your position.

Make any reservation deposit strictly conditional on a satisfactory town planning and DAFO clearance

When purchasing country homes or rustic properties in Almería, never sign a standard reservation form without a customized legal clause: ensure the contract explicitly states that all deposits are fully refundable if the property fails to secure or demonstrate a valid DAFO certificate and clear municipal legal standing certified by your independent solicitor.
