Their proposal is based on technological intermediation: they connect consumers with couriers or drivers, managing demand through algorithms. Formally, many of these companies have argued that workers are self-employed, with commercial-nature contracts, claiming that they enjoy flexibility to decide when and how to work. However, this view has been challenged by courts and lawmakers, who have observed that, in practice, couriers and drivers do not enjoy real autonomy. Dependence on the app, price setting, assignment of orders, and the possibility of sanctions or disconnection demonstrate a business-like control similar to that of any employment relationship. ✍️ Recent case law and regulation In Spain, the Supreme Court has ruled that the relationship between Glovo and its couriers is an employment relationship, as the elements of dependency and subordination are present. This means that the courier does not act as an independent entrepreneur, but as a worker providing services under the organisation and direction of the platform. The regulatory response came with the so-called “Rider Law” (Royal Decree-Law 9/2021), which establishes a presumption of employment status for couriers working for digital platforms. Since its entry into force, companies are required to hire their riders as employees unless they can prove true economic and organisational independence. Even so, the application of this regulation has not been uniform. Some platforms have tried to maintain hybrid models or resorted to contractual formulas aimed at preserving the appearance of autonomy. At the same time, there have been business changes: Glovo, for instance, has announced the direct hiring of thousands of couriers to adapt to the regulation. Arguments in favour of employment status • Algorithmic control: The platform decides rates, routes and delivery times. • Economic dependence: Most couriers rely exclusively on the platform to earn income. • Lack of real autonomy: Although they may choose time slots, they are subject to penalties if they reject orders or disconnect frequently. • Social protection: Employment status guarantees access to Social Security, holidays, severance and collective rights. Arguments in favour of commercial status • Flexible scheduling: Couriers may decide when to connect. • No exclusivity: In theory, they may work for several platforms simultaneously. • Formal autonomy: They present themselves as independent service providers, with the ability to invoice and organise themselves. Conclusion The debate between employment or commercial status reflects the tension between technological innovation and social protection. Although platforms defend commercial status as a symbol of flexibility, reality shows that couriers and drivers are subject to business-like control that fits better within an employment logic. The regulatory and judicial evolution in Spain clearly leans towards employment status as the general rule, representing progress in worker protection, although it raises new challenges in balancing flexibility, competitiveness and social rights within the digital economy. ✨ ⚖️ Welcome to the Online Civil Procedure offered by MCHM Lawyers.
