In Spain, a specific system has been implemented to guarantee the residence rights of those British nationals who were already living in the country before the end of the transitional period on December 31, 2020. This system is mainly based on Article 50 of the Treaty on European Union (TEU) and the Withdrawal Agreement between the EU and the United Kingdom. ✍️ What does Article 50 TEU imply? Article 50 TEU establishes the procedure for a member state to leave the European Union. In the context of Brexit, this article served as the legal basis for the withdrawal of the United Kingdom, and its application has had direct consequences on the rights of British citizens in European territory. To protect those who were already legally residing in Spain before Brexit, a special residence regime was created that recognizes their status as beneficiaries of the Withdrawal Agreement. Who can benefit from this regime? This regime applies to: • British citizens who were legally residing in Spain before December 31, 2020. • Family members of British citizens who were already living in Spain or who join them later, provided the family relationship existed before the end of the transitional period. • British cross-border workers who, without residing in Spain, carried out their work activity in the country before Brexit and continue doing so. Types of residence documents Since July 6, 2020, British citizens can apply for a specific residence document that certifies their status as beneficiaries of the Withdrawal Agreement. This document includes the mention “Article 50 TEU” and can be of two types: • Temporary TIE: Issued to those who had been legally residing in Spain for less than five years. It is valid for five years. • Permanent TIE: Granted to those who had already completed five years of legal residence. It is valid for ten years and provides greater legal stability. Application procedure The procedure varies depending on the applicant’s situation: • Holders of the registration certificate (green card): They must apply for the new residence document, although their certificate remains valid until they obtain the new TIE. • Non-EU family members: If they already held a family member card of an EU citizen, they must apply for the new document replacing the previous one. • New applicants: Those who arrived between July 6 and December 31, 2020 must apply for the document at the immigration office within three months of arrival. Required documentation To apply for the residence document under Article 50 TEU, the following must be submitted: • Form EX-20 or EX-23, depending on the case. • Valid passport. • Proof of payment of the relevant fee (Form 790, code 012). • Recent passport-size photograph. • Updated certificate of registration (padrón). • Documentation proving continuous legal residence (rental contracts, utility bills, registration history, etc.). TIE renewal TIE renewal can be done from 30 days before expiration until 90 days after. However, in practice, some police stations require the card to be expired to start the procedure. It is advisable to check with the corresponding police station to avoid issues. It is also important to note that the relevant date to prove five years of residence is not the issuance date of the TIE, but the date on which legal residence in Spain was recognized. Associated rights British citizens who obtain the residence document under Article 50 TEU retain rights similar to those they had as EU citizens, including: • Right to reside and work in Spain. • Access to public healthcare. • Right to family reunification. • Right to mobility within the Schengen area, subject to certain conditions. Conclusion The residence regime for British citizens in Spain after Brexit, based on Article 50 TEU, represents an effort to guarantee the continuity of rights acquired before the UK’s withdrawal from the EU. Although the process may seem complex, it is designed to provide legal certainty and stability to those who chose to make Spain their home. It is essential for those concerned to be properly informed, keep their documentation updated, and consult the competent authorities to ensure a smooth transition. ✨ ⚖️ Welcome to the Civil Online process offered by MCHM Lawyers.
