However, their involvement is not always mandatory. In this article, we analyze in detail when legal counsel is essential and when it is possible to proceed without it, while keeping in mind the risks involved. ✍️ When Is a Lawyer Mandatory? The obligation to have a lawyer depends on the type of procedure, the amount involved, and the jurisdiction in which it is processed. Below are the main scenarios: 1. Civil Proceedings • Mandatory: In ordinary and verbal trials where the amount exceeds €2,000, as well as in family proceedings (contentious divorces, modification of measures, liquidation of joint property), evictions, mortgage foreclosures, and disputes in homeowners, associations. • Not mandatory: In verbal trials involving amounts below €2,000, such as claims for defective products or minor contractual disputes. 2. Criminal Proceedings • Mandatory: In serious crimes that carry penalties exceeding two years of imprisonment, as well as in abbreviated and ordinary procedures. • Not mandatory: In trials for minor offenses (formerly misdemeanors), although legal advice is strongly recommended. 3. Labor Proceedings • Mandatory: In appeals for reversal or cassation, and in complex lawsuits such as collective dismissals or claims involving large amounts. • Not mandatory: In the first instance of a labor trial, although having a lawyer may be decisive for a successful outcome. 4. Administrative Litigation Proceedings • Mandatory: In lawsuits against actions by the Public Administration, appeals before higher courts, and in certain complex proceedings. • Not mandatory: In administrative appeals before the administration itself or in simple procedures. 5. Appeals and Cassation • Always mandatory: In any appeal before higher courts, regardless of the legal field (civil, criminal, labor, or administrative). Mediation as a Preliminary Requirement: A Key Change in 2025 Since April 3, 2025, the entry into force of Organic Law 1/2025 has introduced a substantial change in access to justice: mediation has become a mandatory step before filing a lawsuit in many civil, commercial, and labor proceedings. This new requirement aims to promote out-of-court resolution of conflicts, ease the burden on the courts, and encourage faster and more cost-effective agreements. The parties must prove that they have attempted to resolve the conflict through mediation by submitting a certificate. Otherwise, the lawsuit may be inadmissible. What Does This Mean for the Lawyer? The role of the lawyer now extends beyond traditional litigation. They must: • Advise on the viability of mediation. • Accompany the client in the alternative dispute resolution process. • Draft out-of-court agreements with legal validity. • Ensure all formal requirements are met so the lawsuit can be admitted. Furthermore, if a party unjustifiably refuses to participate in mediation, they may face procedural consequences, such as dismissal of the lawsuit or an order to pay costs. Is It Advisable to Hire a Lawyer Even If It,s Not Mandatory? The answer is a resounding yes. Although in certain minor procedures the presence of a lawyer is not required, their involvement can make the difference between success and failure. A lawyer brings not only technical knowledge, but also strategy, experience, and negotiation skills. Acting without legal counsel can lead to procedural errors, loss of rights, or even unfair judgments. Therefore, even when not mandatory, it is highly advisable to have the support of a legal professional. ✨ ⚖️ Welcome to the Online Civil Procedure offered by MCHM Lawyers.
