This procedure is regulated in Articles 812 to 818 of the Civil Procedure Act (LEC) and is designed to facilitate the collection of debts without the need for an ordinary trial. Below is the legal regulation and the steps to follow to carry out a monitoring process. ✍️ Legal Regulation The monitoring process is contemplated in the LEC, specifically in Title III, Chapter I. This procedure allows for the collection of monetary debts of any amount, as long as certain requirements are met and the appropriate documentation is provided. It is not necessary to have a lawyer or procurator to initiate the process, although their intervention will be mandatory if the debt exceeds 2,000 euros and the debtor opposes. The requirements to initiate a monitoring process are as follows: • Liquid Debt: The debt must be quantifiable in monetary terms. • Due Debt: The payment deadline for the debt must have expired. • Enforceable Debt: There must be no legal impediment to claiming the debt. • Determined Debt: The owed amount must be clearly specified. Steps to Follow 1. Submission of the Initial Petition: The creditor must submit a request before the corresponding First Instance Court at the debtor´s address. This request must include the identification of the creditor and debtor, the claimed amount, and documentation that proves the debt. It is not necessary to have a lawyer or procurator for this initial phase. 2. Payment Demand to the Debtor: Once the request is accepted, the court will send a payment demand to the debtor, granting a 20 business day period for payment or opposition. This demand will be notified to the debtor at their address. 3. Debtor´s Response: • Payment of the Debt: If the debtor pays the debt within the established deadline, the process will be concluded. • Debtor´s Opposition: If the debtor opposes, the monitoring process will transform into an ordinary or verbal trial, depending on the amount of the debt. In this case, lawyer and procurator intervention will be required. • Debtor´s Inaction: If the debtor does not respond to the payment demand, the court will issue a decree that ends the monitoring process and allows the creditor to begin forced execution of the debt. 4. Debt Execution: If the debtor does not pay or oppose, the creditor can request the debt´s execution. In this phase, the court can seize the debtor´s assets to satisfy the debt. Lawyer and procurator intervention is mandatory if the debt exceeds 2,000 euros. Necessary Documentation To prove the debt, the creditor must present documents that demonstrate its existence and amount. These documents may include: • Invoices, delivery notes, certifications, telegrams, faxes, among others. • Documents signed by the debtor or bearing their seal, imprint, or mark. • Commercial documents that demonstrate an ongoing relationship between the creditor and debtor. Advantages of the Monitoring Process The monitoring process offers several advantages, including: • Speed and Simplicity: It is a quick procedure that allows for the debt collection process to be completed in a straightforward manner. • Lower Cost: It is not necessary to have a lawyer or procurator to initiate the process, which reduces initial costs. • Effectiveness: It provides a judicial resolution that facilitates debt execution in case of debtor´s inaction. In conclusion, the monitoring process is an effective tool for the collection of monetary debts in Spain. Its regulation in the LEC and the clear steps to follow make it an attractive option for creditors seeking a fast and cost-effective solution to collect their debts. ✨ ⚖️ Welcome to the Online Civil Process offered by MCHM Lawyers.
