In this scenario, the Spanish legal system offers two main routes to claim the owed amounts judicially: the verbal trial and the Payment Order Procedure. Choosing between one or the other is not a minor matter, as each procedure has procedural, strategic, and economic implications that must be carefully considered. ✍️ 1. Legal basis and nature of each procedure Verbal trial The verbal trial is a declarative procedure regulated in Article 250.1.1º of the Spanish Civil Procedure Act (LEC), which establishes that claims for rent collection must be processed through this route, regardless of the amount. It is the natural channel to claim unpaid rents arising from lease agreements, both for housing and other uses. Payment Order Procedure On the other hand, the Payment Order Procedure, regulated in Articles 812 to 818 of the LEC, is a special and summary process designed to claim monetary debts that are liquid, due, and enforceable, provided they are documented. In the context of rentals, it can only be used to claim unpaid rents of urban properties and does not allow the accumulation of other actions such as eviction. 2. When to opt for the verbal trial? The verbal trial is preferable in the following cases: • When future rents are to be claimed: Article 220 LEC allows including in the judgment the order to pay rents accrued after the claim, something that the Payment Order Procedure does not admit. • If the eviction action is accumulated: In cases where the tenant continues to occupy the property, it is more effective to file a joint claim for eviction and rent recovery. • When the tenant,s address is unknown: The verbal trial allows notification by edict on the court bulletin board, whereas the Payment Order Procedure requires personal notification. • To obtain cost awards: If a prior payment request has been made and the tenant does not comply, the verbal trial allows requesting cost awards, which does not occur if the tenant pays during the Payment Order Procedure. 3. When is the Payment Order Procedure more convenient? The Payment Order Procedure may be advantageous in situations such as: • When the tenant has already left the property and only unpaid rents are to be recovered. • If clear and sufficient documentation (contract, receipts, communications) is available to prove the debt. • When speed is sought: If the tenant does not object, the procedure ends with an order that allows direct enforcement without the need for a trial. • For low-amount claims: In cases where the debt does not exceed 2,000 euros, it is not mandatory to have a lawyer or solicitor, which reduces costs. 4. Territorial jurisdiction This aspect also influences the choice of procedure: • In the verbal trial, the competent court is the one where the leased property is located. • In the Payment Order Procedure, jurisdiction falls to the court of the defendant,s residence, which may generate complications if the tenant has changed residence. 5. Risks and strategic considerations Choosing the wrong procedure can involve unnecessary delays, additional costs, and evidentiary difficulties. For example, if a Payment Order Procedure is initiated and the tenant objects, the procedure becomes a verbal trial, which can lengthen the process. Additionally, in the Payment Order Procedure, future rents cannot be claimed nor can actions be accumulated, which limits its usefulness in certain cases. 6. Conclusion The decision between verbal trial and Payment Order Procedure should be based on a comprehensive assessment of the case: the property situation, the tenant,s conduct, the available documentation, the amount of the debt, and the landlord,s objectives. In general terms, the verbal trial offers greater legal certainty and flexibility, while the Payment Order Procedure can be faster and more economical if there is no objection. In any case, having specialized legal advice is key to ensuring an effective claim and avoiding procedural errors that could compromise the outcome. ✨ ⚖️ Welcome to the Civil Online process offered by MCHM Lawyers.
