👉 The new legal maze of abusive clauses: real protection or regulatory illusion?
✨
💬In recent years, the battle against abusive clauses in banking contracts has ceased to be a purely technical issue and has become a matter of social justice. However, with the entry into force of Organic Law 1/2025 and the Justice Efficiency Law, many consumers wonder whether they are truly more protected or if the legal maze they must navigate has simply become more sophisticated. 🔏
A new door… with more locks
Since April 2025, consumers can no longer go directly to court to claim the nullity of abusive clauses. The new regulation requires that the out-of-court route be exhausted first. In theory, this aims to encourage quick agreements and prevent court congestion. In practice, many financial institutions have turned this prior step into a deterrent filter, offering settlements well below what was claimed or simply ignoring the requests.
Late payment interest: exemplary punishment or dead letter?
One of the most striking aspects of the reform is the imposition of a 50% late payment interest over the legal interest rate if the entity does not act in good faith. This measure is intended to penalize unjustified delays and compensate consumers for lost time. However, its practical application still raises doubts: how many judges will apply it ex officio? How many consumers will reach that stage without giving up earlier?
Banks adapt… and defend themselves
Financial institutions have not taken long to adjust their strategies. Some have strengthened their customer service departments to handle claims, while others have chosen to toughen their negotiation criteria. In many cases, they continue to argue the statute of limitations of the action or the validity of the clauses, even when they have already been declared null and void by the courts.
The consumer, between hope and exhaustion
For the average citizen, facing a bank remains a daunting task. Although the legal framework has formally improved, the reality is that many consumers find themselves trapped between procedures, technicalities, and misleading offers. The role of the specialized lawyer becomes almost indispensable, which adds an additional cost to the pursuit of justice.
Conclusion: a reform with lights and shadows
The new legislation represents progress in the fight against banking abuses but also raises new challenges. The key will lie in its effective application and in the consumer’s ability to withstand pressure and claim what is rightfully theirs. Because, in the end, justice must not only be written in law but also be within reach of those who need it.
